El comercio global de bienes y servicios ha experimentado un notable crecimiento, alcanzando los 31 mil millones de dólares en 2022, con China liderando las exportaciones a nivel mundial (World Trade Statistical Review, 2023). América del Sur ha registrado un crecimiento del 1.4% en sus exportaciones, consolidándose como una región en crecimiento para el comercio internacional, con China como su principal socio comercial (World Trade Organization, 2023; Comisión Económica para América Latina y el Caribe, 2023).
En octubre de 2024, el Megapuerto de Chancay iniciará operaciones, marcando un hito clave para el comercio entre Sudamérica y Asia, especialmente con China. Este proyecto se proyecta como un motor crucial para el crecimiento económico del Perú, aportando un estimado de 0.2 puntos al Producto Bruto Interno (PBI) anual del país (El Peruano, 2023).
Se espera que el Megapuerto de Chancay sea fundamental para el comercio eficiente entre ambas regiones, con una reducción significativa en los tiempos de tránsito de mercancías entre 25 y 28 días, comparado con los actuales 40 días, y una estimada disminución del 15% en los costos logísticos para las empresas (El Peruano, 2023). Este proyecto, con previsiones de iniciar operaciones en octubre del presente año, facilitará un mayor volumen de ingreso y salida de mercadería en la región sur del continente.
La gestión eficiente de los derechos de propiedad intelectual se beneficiará con esta nueva infraestructura al concentrar el ingreso y salida de mercadería en un solo punto. Este enfoque estratégico permitirá retener un mayor volumen de mercadería infractora al momento de su ingreso al país, mejorando significativamente la protección de los derechos de propiedad intelectual en Sudamérica.
En este marco, la infraestructura no solo consolida los lazos comerciales entre Sudamérica y Asia, sino que también se presenta como una herramienta efectiva para salvaguardar los derechos de propiedad intelectual, particularmente en lo que concierne a las infracciones de marca en toda la región. Además, se abre la posibilidad de desarrollar e implementar estrategias específicas de propiedad intelectual, centrándose en la eficiencia proporcionada por el Megapuerto de Chancay, que se estima su pleno funcionamiento a partir del próximo año.

South America has seen a growth of 1.4% in its exports, establishing itself as a growing region for international trade, with China as its main trading partner (World Trade Organization, 2023; Economic Commission for Latin America and the Caribbean, 2023).
In October 2024, the Chancay Megaport will commence operations, marking a significant milestone for trade between South America and Asia, particularly with China. This project is projected to be a pivotal driver for Peru’s economic growth, contributing an estimated 0.2 points to the country’s annual Gross Domestic Product (GDP) (El Peruano, 2023).
The Chancay Megaport is expected to play a crucial role in efficient trade between both regions, with a substantial reduction in transit times for goods from 25 to 28 days, compared to the current 40 days, and an estimated 15% decrease in logistical costs for businesses (El Peruano, 2023). This project, slated to commence operations in October of the current year, will facilitate increased inbound and outbound merchandise flow in the southern region of the continent.
The efficient management of intellectual property rights will benefit from this new infrastructure by consolidating the entry and exit of goods at a single point. This strategic approach will enable the retention of a larger volume of infringing merchandise upon entry into the country, significantly enhancing the protection of intellectual property rights in South America.
Within this framework, the infrastructure not only strengthens trade ties between South America and Asia but also emerges as an effective tool for safeguarding intellectual property rights, particularly concerning trademark infringements throughout the region. Furthermore, the opportunity arises to develop and implement specific intellectual property strategies, focusing on the efficiency provided by the Chancay Megaport, anticipated to operate fully from the upcoming year.
